4. Subscription Plans and Pricing

4.2 Premium Subscription Terms

When you subscribe to our Premium plan:

  • You will be charged $9.99 per month on a recurring basis
  • Your subscription begins immediately upon payment confirmation
  • You will be billed on the same day each month until you cancel
  • There is NO FREE TRIAL PERIOD
  • You will have immediate access to all Premium features

NO FREE TRIAL: Your Premium subscription begins immediately upon purchase. There is no free trial period. You will be charged $9.99 immediately and on a recurring monthly basis thereafter.

4.3 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor:

  • You must provide valid payment information to subscribe
  • You authorize us to charge your payment method on a recurring monthly basis
  • You are responsible for maintaining valid payment information
  • Stripe's Terms of Service apply to all payment transactions
  • We do not store your complete credit card information

4.4 Price Changes

We reserve the right to modify our pricing at any time. If we change the price of the Premium subscription:

  • We will provide at least 30 days' advance notice
  • The new price will apply to your next billing cycle after the notice period
  • You may cancel your subscription before the new price takes effect
  • Continued use of the Service after the price change constitutes acceptance of the new price

5. Refund Policy

NO REFUNDS: ALL SUBSCRIPTION FEES ARE NON-REFUNDABLE. BY SUBSCRIBING TO OUR PREMIUM PLAN, YOU ACKNOWLEDGE AND AGREE THAT YOU WILL NOT RECEIVE A REFUND UNDER ANY CIRCUMSTANCES, EXCEPT AS REQUIRED BY LAW OR JUDICIAL ORDER.

5.1 No Refund Policy

We maintain a strict no-refund policy for all subscription fees:

  • Monthly subscription fees are non-refundable
  • No refunds will be issued for partial months
  • No refunds will be issued if you cancel your subscription mid-cycle
  • No refunds will be issued for unused Premium features
  • No refunds will be issued due to dissatisfaction with the Service
  • No refunds will be issued for technical issues or service interruptions

5.2 Exceptions

Refunds may only be issued in the following circumstances:

  • Legal Requirement: Where refunds are required by applicable consumer protection laws
  • Judicial Order: Where a court of competent jurisdiction orders a refund
  • Billing Error: Where we have made a clear billing error (e.g., duplicate charges)
  • Unauthorized Charges: Where charges were made without your authorization (subject to verification)

5.3 Cancellation

You may cancel your Premium subscription at any time:

  • Cancellation takes effect at the end of your current billing cycle
  • You will retain access to Premium features until the end of the paid period
  • No refund will be issued for the remaining days in your billing cycle
  • You can cancel through your account settings or by contacting us
  • After cancellation, you will revert to the Basic (Free) plan

6. License and Intellectual Property

6.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Use Premium features if you have an active Premium subscription

6.2 Ownership

are owned by MotoBeginner.com or our licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.3 Restrictions

You agree NOT to:

  • Reverse engineer, decompile, or attempt to extract source code

The arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and, where appropriate, the AAA's Supplementary Procedures for Consumer Related Disputes.

11.4 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.

11.5 Judicial Forum

If arbitration is not applicable or enforceable, you agree that any judicial proceeding shall be brought exclusively in the federal or state courts located in the jurisdiction where MotoBeginner.com operates, and you consent to personal jurisdiction in those courts.

These Terms shall be governed by and construed in accordance with the laws of the United States and applicable state law, without regard to its conflict of law provisions.

13. Modifications to Terms

14. Termination

14.1 Termination by You

You may terminate your account at any time by:

  • Deleting your account

Upon termination:

  • Your access to Premium features will end at the end of your billing cycle
  • No refund will be issued for the remaining subscription period
  • You will revert to the Basic (Free) plan unless you delete your account

14.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

  • You violate these Terms of Service
  • You engage in fraudulent, illegal, or abusive behavior
  • Your payment method fails or is declined
  • We are required to do so by law
  • We discontinue the Service

Upon termination by us:

  • Your access to the Service will be immediately revoked
  • No refund will be issued except as required by law
  • We may delete your account and data

14.3 Effect of Termination

Upon termination of your account:

  • All licenses granted to you will immediately terminate
  • You must cease all use of the Service
  • Sections of these Terms that by their nature should survive will survive (e.g., disclaimers, limitations of liability, indemnification)

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MotoBeginner.com regarding the Service and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

15.6 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and MotoBeginner.com as a result of these Terms or your use of the Service.

15.7 Notices

We may provide notices to you via email, regular mail, or postings on the Service. Notices to us must be sent to admin@motobeginner.com.

15.8 Headings

The section headings in these Terms are for convenience only and have no legal or contractual effect.
